A criminal case initiated on hindrance to implementation of observer’s authorities in polling station N 04/05

A criminal case was initiated in the Investigative Division of Arabkir administrative district of Yerevan Investigative Department of the RA Investigative Committee on hindrance to implementation of the observer’s authorities in polling station N 04/05.

On December 6, 2015 a publication was inserted in the website “asparez.am” informing that the head of the commission seized the mobile phone with videos from the observer, removed its content and returned it.

On the base of the publication materials were prepared in the Investigative Division of Arabkir administrative district to find the mentioned circumstances.

The observer of the organization “Transparency International” Gohar Abrahamyan submitted an explanation and a report on the allegation that during referendum on Constitutional reforms held on December 6, 2015, while capturing the possible case of double voting found in polling station N 04/05 the head of commission S. Avagyan seized her mobile phone hindering to implementation of her authorities.

Considering that in the prepared materials there are apparently sufficient data on features of crime envisaged by the Article 149 of RA Criminal Code, a criminal case was initiated in the Investigative Division of Arabkir administrative district pursuant to the Article 149 of RA Criminal Code. The criminal case was sent to Prosecution Office to be sent according to investigative subordination.

Thus, 11 criminal cases on electoral breaches recorded during referendum on Constitutional reforms (Article 153 of RA Criminal Code) are investigated in the proceeding of the RA Investigative Committee, 3 more criminal cases were initiated according to the Article 149 which were sent according to investigative subordination.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
