Employment Procedure
The citizen of the Republic of Armenia, who permanently resides in the Republic of Armenia, with a higher legal education of a certified specialist or bachelor's, master's degree, can be employed in the RA Investigative Committee.
The main requirements to the persons holding autonomous position are defined by the RA Law “On RA Investigative Committee”. Pursuant to it, the RA citizen with a profession of a lawyer who
has completed compulsory military service (except for females or the cases envisaged by the part 2 of this article) or is a reserve officer
is fluent in Armenian
does not have a physical defect or illness that hinders the appointment of a person holding autonomous position in the Investigative Committee to his / her appointment to the position (the list of physical defects or diseases is defined by the Government of the Republic of Armenia)
can be appointed to a position in the committee.
The citizen who
has been found incompetent or has limited competency by a judicial act which has come into effect,
has been deprived of the right to hold any position in the public service by a judicial act which has come into effect,
has been convicted for committing a crime regardless of whether the conviction has been expunged or cancelled, in the order defined by law,
is subject to criminal prosecution,
against whom there is a decision on termination of criminal prosecution on non-acquittal base,
does not meet the requirements defined by the part 1 of this article
cannot be employed in the Investigative Committee.
The age limit for holding a post in the Investigative Committee is 60. After the maximum age has been reached the Chairman of the Investigative Committee can extend the term of service for 5 years.
The list of Candidates for Autonomous Positions in the Investigative Committee
The Qualification Commission of the RA Investigative Committee supplements the list of the candidates of those holding autonomous position in the Investigative Committee at least once a year.
In order to supplement the list of the candidates of the employees holding autonomous position in the Investigative Committee, at least a month before the application for acceptance the Qualification Commission publishes an announcement on qualification testing in press with at least 3000 copies, in the official website of public notices (www.azdarar.am) , as well as in the official website of the Investigative Committee mentioning the application deadlines, place, the day of written examination, as well as the number of places subject to be supplemented.
The person aspiring to be involved in the list of candidates of the employees holding autonomous position in the Investigative Committee submits
identification document;
document certifying higher legal education;
card containing biographical data – with description of professional legal activity after acquiring the profession of a lawyer attaching appropriate evidence (among them a passport of position or other documents which certify professional responsibilities in the work under consideration;
document certifying compulsory military service or exemption from compulsory military service or deferment in accordance with the law (if he is a male candidate);
document on the absence of physical defects or diseases hindering to holding the position in the Investigative Committee issued in accordance with the procedure established by the Government of the Republic of Armenia.
The applicant has the right to submit letters of recommendation as well.
The acceptance of the applications in violation of the deadline for submission or not complying with the requirements of the law shall be rejected and they are subject to be returned by the Qualification Commission within three working days.
The applicants take a written examination and after passing it they take an oral examination, as well.
The persons who have passed the written and oral examinations fill in the questionnaire.
The procedure for conduction of written and oral examinations, the range of the questions included in the questionnaire and the completion procedure are defined by the Chairman of the RA Investigative Committee.
Having received a positive mark in the examinations and a positive conclusion after completing the form, by the decision of the Qualification Commission, the applicants are involved in the list of the candidates of the employees holding autonomous position in the Investigative Committee.
The applicants having received a positive conclusion, by the decision of the Qualification Commission, are involved in the list of candidates of the employees holding autonomous position in the Investigative Committee.
The persons involved in the list of the candidates of the employees holding autonomous position in the Investigative Committee do a training course in the Academy of Justice and take a qualification examination. The person, who has not passed the qualification examination, by the decision of the Qualification Commission, is removed from the list of the candidates of the employees holding autonomous position in the Investigative Committee.
The person is exempted from trainings and qualification examination if
he has three years’ professional work experience of a prosecutor, a judge, an investigator or a lawyer if it has not been 5 years since he quitted the job or
if the person is a Doctor of Law or
a Candidate of Law and has 5 years’ experience in law.
Through the motion of the person exempted from the training course in the Academy of Justice the Qualification Commission can consider the issue of involving the applicant in the list of the candidates of the employees holding autonomous position in the Investigative Committee and the list of official promotion.
The decisions made by the Qualification Commission can be appealed in the administrative court within 10 working days after receiving the decision. The court examines the case and gives a solution to it within 15 working days after receiving it.
Appealing the rejection of the application acceptance by the Qualification Commission does not suspend the procedure of application acceptance, as well as making the list of candidates of the employees holding autonomous position in the Investigative Committee, defined by law. In case the court finds the rejection of the application acceptance unlawful, the application of the applicant is considered by the Qualification Commission.
The investigators of the general departments of the central office of the Investigative Committee, departments and divisions, departments, divisions and garrison investigative units of General Military Investigative Department, Investigative Department of Yerevan, the investigative divisions of administrative districts of Yerevan, divisions of regional investigative departments of the Investigative Committee are appointed by the Chairman of the Investigative Committee out of persons involved in the list of the candidates of the employees holding autonomous position in Investigative Committee who have done a training course in the Academy of Justice, have passed the qualification examination or have been exempted from the training in the Academy of Justice, in the order defined by law. If the person is appointed in the position, he is removed from the list of the candidates of the employees holding autonomous position in the Investigative Committee by the Chairman of the Investigative Committee.
