Preliminary Investigation of Criminal Proceeding Initiated on Causing Serviceman to Commit Suicide Completed
Preliminary investigation of the criminal proceeding initiated on causing a serviceman to commit suicide was completed in General Military Investigative Department of the RA Investigative Committee.
In the course of the preliminary investigation of the criminal proceeding apparent factual data were obtained indicating that two conscript servicemen of the military unit of the RA Ministry of Defense negligently caused the conscript serviceman of the same unit to commit suicide by showing cruel treatment against him.
Particularly, the two servicemen for various reasons regularly uttered sexual insults towards S.H., then showed cruel attitude to him in a group causing bodily injuries.
During the preliminary investigation of the criminal proceeding it was found out that the bodily injury on the serviceman’s face was noticed by the Deputy Commander for Logistics of the Rifle Battalion of the Ministry of Defense Military Unit, who found out that the mentioned injuries had been caused by the two servicemen of the unit and did not report about the crime according to the established procedure. Instead, he ordered to conceal the injury around the serviceman's eye with makeup.
Consequently, due to the aforementioned actions of the three persons, S.H. discharged two shots in a burst with the issued assault rifle, targeting the jaw area, committing suicide.
Public criminal prosecution was initiated against two persons according to the Point 1 of the Part 2 of the Article 522 of RA Criminal Code, against 1 person – according to the Part 3 of the Article 549 of RA Criminal Code.
Detention was applied as a pretrial measure against two persons, home detention-against one person.
The criminal proceeding with the bill of indictment was sent to the prosecutor.
