Case of Illness Simulation by High-Ranking Military Officer Disclosed

 

In the result of large-scale investigative and procedural actions conducted within the criminal proceeding investigated in General Military Investigative Department of the RA Investigative Committee it was found out that R.H., who held the position of Deputy Chief-Commander of Staff of the military unit N, during the declared state of martial law, deliberately evading the fulfillment of duties deriving from his position during combat operations, decided to suspend military service duties by simulating illness. 

Particularly, without informing his superior command, R.H. went to the military hospital, where he presented false information that did not correspond to reality, as well as complaints that did not actually exist  As a result, he was admitted for inpatient treatment based on a preliminary diagnosis. 

Accordingly, the simulation of illness exhibited by R.H. resulted in his temporary suspension from the performance of specific military duties deriving from his official position, for the period from November 3 to November 16, 2020.

Public criminal prosecution was initiated against R.H. according to the Part 3 of the Article 527 of RA Criminal Code. 

The criminal proceeding with the bill of indictment was sent to the prosecutor for approval and referral to court. 

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
