Senior investigator subjected to disciplinary liability for not considering the witness’ motion within the prescribed term


By the order of the Chairman of RA Investigative Committee Aghvan Hovsepyan, the senior investigator of Malatia-Sebastia administrative district was subjected to disciplinary liability for not considering the motion of the witness within the term defined by RA Criminal Procedure Code.

Through investigation conducted in the Department of Internal Security of RA Investigative Committee, it was found that the senior investigator of Malatia-Sebastia administrative district violated the norms defined by the Article 199 of RA Criminal Procedure Code while implementing his authorities during preliminary investigation of the criminal case initiated according to the Point 2 of the Part 3 of the Article 182 (Extortion in particularly large amount), that is he did not consider the motion of the witness within 5 days and did not answer him in the order defined by law.

On the base of the decision of Disciplinary Commission of RA Investigative Committee on availability of violation and the guilt of the employee of the Investigative Committee and taking the Point 2 of the Part 1 of the Article 30 of RA Law “On RA Investigative Committee” into consideration, the Chairman of the Investigative Committee signed an order on using “Reprimand” as a disciplinary penalty against the senior investigator of Malatia-Sebastia administrative district.

The leadership of RA Investigative Committee will be consistent to prevention of disciplinary violations of the employees, to the abolishment of violation causes and strengthening the service discipline highlighting the comprehensive, complete and objective examination of circumstances of the criminal case, as well as the maintenance of procedural norms.
