Person Declared unfit for Compulsory Military Service underwent Medical Examination instead of Person Seeking Exemption from Military Service:  Preliminary Investigation of Criminal Proceeding Completed

 

As a result of large-scale investigative and evidentiary actions conducted in the course of the preliminary investigation of the criminal proceeding initiated in General Military Investigative Department of the RA Investigative Committee, it was found out that Zh.S., being aware that G.D. was declared unfit for compulsory military service due to his health condition during the 2022 winter conscription, and that N.H. pursued the unlawful goal of permanently exempting his son, R.Kh., from military service, Zh.S., by means of proposing and giving advice, reached a prior agreement with the latter to have G.D. undergo the relevant medical examinations instead of R.Kh., to forge documents and use them by submitting them to the military commissariat, thereby organizing and directing the commission of the mentioned crime.

Particularly, at Zh.S.’s instruction, on May 30, 2024, instead of his son, N.H. accompanied G.D. to medical center, where they presented R.Kh.’s birth certificate and instead of him G.d. underwent an MRI examination. 

As a result, the doctor made a false document, not realizing that G.D. was examined instead of R.Kh.

Being aware that the document made about him was false, R.Kh. submitted it to the Military Commissariat of the RA Ministry of Defense in order to be recognized as unfit for compulsory military service and to be finally and illegally exempted from compulsory military service, on the basis of which the latter was recognized as fit for military service with restrictions, since after the adoption of the RA Government’s decision dated April 18, 2024, the presence of the aforementioned disease no longer exempts the conscript from compulsory military service. 

Public criminal prosecution was initiated against R.KH. according to the Part 1 of the Article 457 of RA Criminal Code, against N.H., G.D. according to the Part 2 of the Article 457 of RA Criminal Code, and against Zh.S. according to the Part 2 of the Article 46-457 of RA Criminal Code. 

The criminal proceeding with the bill of indictment was sent to the prosecutor for approval and referral to court. 

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
