In the course of the preliminary investigation of the criminal proceeding investigated in Kotayk Regional Investigative Department of the RA Investigative Committee, apparent factual data were obtained on the allegation that after a dispute arisen between the parties, which ended in stabbing, H.G., with the intention of seeking revenge, incited his friend to kill A.O.

Particularly, T.M., arriving in Armenia, with prior agreement with H.G., as part of a group, illegally procured a factory-manufactured rifled firearm, assault rifle, cartridges classified as military ammunition, a combat grenade and kept them in his residence. 

With the intent of carrying out their criminal plan, T.M., at the instigation of H.G., with direct intent, performed preparatory actions aimed at the murder of A.O., namely: illegally keeping a firearm, ammunition, and a grenade; renting a house adjacent to A.O.’s residence; monitored A.O.’s movements; and took photographs. However, A.O. discovered him and, together with his friends, subjected him to beating. 

Subsequently, in order to carry out their criminal intent, T.K., in prior agreement with H.G. and as part of a group, continued to illegally keep the aforementioned items while seeking a suitable opportunity to kill A.O. However, they were unable to complete the crime included in their intent due to unforeseen circumstances, as the plan to carry out the retaliation was prevented, they were discovered and arrested as a result of extensive operational-intelligence measures taken by the employees of the Ministry of Internal Affairs, as well as investigative, and evidentiary actions. 

During the searches conducted within the framework of the criminal proceeding the mentioned weapon-ammunition were found. 

Public criminal prosecution was initiated against T.M. according to the Point 11 of the Part 2 of the Article 43-155, and the Part 2 of the Article 335 of RA Criminal Code, against H.G. according to the Point 11 of the Part 2 of the Article 46-43-155 and the Part 2 of the Article 335 of RA Criminal Code. 

Detention was applied as a pretrial measure against them.
