Preliminary Investigation of Criminal Proceeding on Attempt of Organizing Mass Disorders in Syunik on April 21, 2021 Completed on Four Persons
The head of the security department of one of the companies operating in Syunik region, having learned in advance about the planned visit of the RA Prime Minister to Syunik region on April 21, 2021, on April 20, using the authority and influence of his position to create obstacles, sent a voice message to a company employee and emphasized the preparation of hooligan actions planned by them in connection with the visit of the RA Prime Minister.
On April 21, 2021 during the visit of the RA Prime Minister with a group of other officials to Agarak, then Meghri settlements, A.G., in order to achieve his criminal goal, to raise a wave of dissatisfaction and intolerance among the population towards state bodies and officials, to justify and give a big boost to illegal actions that violate public order, to involve a large number of people in committing illegal acts, to increase the number of participants, to incite them to commit violence, destruction, damage to property, and other unlawful acts, to push the individuals involved to more aggressive actions, to turn the aforementioned illegal actions into mass riots, reached a prior agreement with the head of another department of the company, according to which through a journalist and operator from one of the media and with the involvement of that media, he ensured the live broadcast of the organized illegal actions of the events taking place.
The media operator, in turn, provided live broadcasts, not filming and covering the details of the official visit, but rather the illegal actions, in order to assist in the organization of mass disorder, which was accompanied by justifying the mentioned illegal actions by him and the journalist, making insulting statements towards officials, aiming to involve the population in the ongoing illegal activities.
During that time, A.G. organized the commitment of hooliganism by a group of people, which was manifested by the following actions; a group of people willfully roughly violated the public order; namely publicly uttered sexual insults, insulting statements in a display of contempt for moral norms, showing obvious disrespect and undisguised contempt for residents of adjacent buildings, employees of public facilities, and numerous people who had come to the meeting and watched the live broadcast, they did not obey the legal requirements of the law enforcement bodies that performed the duty of maintaining public order and are representatives of the government, but on the contrary, they pushed and hit the latters, which was also accompanied by damage to someone else's property. Particularly, during the hooliganism they damaged the front door of the car driven by the security personnel of the RA Prime Minister, tore the clothes of the head and employee of the State Protection Service, tore off the shoulder strap of a police officer, and tore the latter’s uniform. As a result, public order and the smooth operation of transport were disrupted, law-abiding and stable behavior was not maintained in public places, and people's daily lives were disrupted, the movement and meetings with the population of the RA Prime Minister and those accompanying him were also hindered.
Besides, organized by A.G., more than two dozen people gathered in the area adjacent to Goris-Kapan highway, where a group of representatives from the settlements of Goris community also came on M.H.’s instruction. Within the framework of prior agreement reached by them, while the Prime Minister was passing through the aforementioned area, instructions were given to the people gathered at the aforementioned location in order to carry out their intention to grossly disrupt public order, in order to interest them and keep them from leaving the area for several hours, they provided them with food and set up tables on a hill near the Goris-Kapan highway, and in order to arouse the desire to participate in the commission of a crime among the gathered people, to influence them, to instill determination to commit hooligan acts, and to motivate them to take active actions, they served alcohol.
Continuing their criminal activities aimed at organizing and directing hooliganism, M.H. and H.A. instructed the gathered people to block the road and obstruct the movement of the motorcade of the RA Prime Minister while it was passing through the given section of the road.
In addition, organized by M.H. and H.A. eggs were collected and distributed to the gathered people in order to hit the motorcade serving the RA Prime Minister, after which M.H. instructed the latters to hit the cars in the motorcade with eggs.
Then M.H. and H.A. led the commitment of the crime, particularly, on the latters’ instructions, most of those involved in hooliganism gathered on the side of the road leading to Goris and while the motorcade of the RA Prime Minister and his accompanying persons was leaving from Kapan to Goris, near the settlement of Shurnukh, those involved in hooliganism, among them M.H., showed blatant disrespect and undisguised contempt for the residents of the settlement and the numerous people watching the live broadcast of the events, publicly uttered sexual insults, insulting expressions, did not obey the legal requirements of the law enforcement bodies that performed the duty of maintaining public order and are representatives of the government, and they willfully hit state-owned vehicles, which are on the balance sheet of the RA National Security Service, with eggs, among them the car serving the RA Prime Minister, which was also filmed by an employee of the company's security department, and the video was posted and distributed online.
As a result, under unforeseen circumstances, A.G. could not complete the crime, due to the restrained and balanced behavior displayed by the police officers, employees providing security for the RA Prime Minister, the refraining from applying lawful coercion in individual cases to organized, provocative illegal actions, as well as the broad circle of society displaying law-abiding behavior and not participating in illegal actions, the illegal behavior of the participants did not escalate into mass disorder.
Public criminal prosecution was initiated against A.G. according to the Part 1 of the Article 44-46-327, against Z.T., A.G. and A.M. according to the Part 1 of the Article 46-44-327 of RA Criminal Code.
Mortgage and absence ban were applied as a pretrial measure against A.G., Z.T. and A.G., absence ban against A.M..
The criminal proceeding on the part of four persons, with the bill of indictment, was sent to the prosecutor.
