Preliminary Investigation of Criminal Proceeding on Preparation to Usurp Power by Group Members Completed
Preliminary investigation of the criminal proceeding investigated in General Department for Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security of the RA Investigative Committee on preparing to usurp power by a group of people with prior agreement, was completed on three persons.
Through investigation it was found out that S.G., Ye. S. and A.M. with prior agreement with unidentified persons committed preparation of usurping power, namely willfully created conditions for usurping the RA power; possessing the authorities of the RA Government by using violence or threatening to use violence.
Particularly, the mentioned people, with the intent to usurp the RA power, in 2024 recruited a number of persons under the pretext of undergoing three-month training and during that time becoming familiar with new heavy weapons, learning the skills to use them, then, after returning to the RA, performing combat duty, as well as transferring knowledge to other people for remuneration, corresponding payment for each. Organized by S.G., A.Ye., A.H., Ye.S. and other unidentified persons, the recruited people left abroad in several groups, where they underwent initial checks, among them through a polygraph device, during which they tried to find out the personal features and views of the mentioned people, their relation to the RA law enforcement bodies.
After the initial checks the members of the criminal group placed the mentioned people at the territory under A.S.’s control and conducted indoor training exercises with weapons already known to them. In addition, they told them that the training was aimed at returning to the Republic of Armenia and removing the current government; in this way they willfully created conditions to usurp the power in the RA.
After some of the recruited people had opposed the statements and had refused to take part in the armed revolution prepared in the RA, with the intent to eliminate the grievances, to complete the criminal intention and to continue the preparation of the recruited people, S.G. and A.Ye. tried to deny the fact that the recruitments had been organized to usurp the power in the RA. However, the mentioned people refused to take part in it and returned to the RA. The members of the criminal group did not complete the crime under unforeseen circumstances; namely they could not begin the commission of the objective aspect of the crime included in the intent due to disclosure of the crime by the RA law enforcement bodies, as a part of the recruited people had refused to take part in the acts and returned to the RA.
Public criminal prosecution was initiated against S.G., Ye. S. and A.M. according to the Part 1 of the Article 43-419 of RA Criminal Code.
Detention was imposed as a pretrial measure to them.
The criminal proceeding with the bill of indictment on S.G., Ye. S. and A.M. was sent to the prosecutor for approval and referral to court.
