Damage in Particularly Large Amount Caused to Condominium by Manager
In the course of preliminary investigation of the criminal proceeding initiated in Tavush Regional Investigative Department of the RA Investigative Committee apparent factual data were obtained on the allegation that the manager of one of the condominiums operating in the region donated the 349.4 square meter semi-basement area to his relative under the contract.
After it, in order to legitimize the acquisition of property obtained through criminal means, to conceal the true ownership of the property, and to distort the source of criminal origin, the manager of the condominium divided the 349.4 square meter semi-basement area into two parts.
Then at the manager’s instruction, 247.2 square meter area was sold to a Tavush resident for 2 million AMD, the other 102.2 square meter area was alienated to his wife under formal sales contract for 1 million 500 thousand AMD. The latter alienated the above-mentioned area for 5 million 500 thousand AMD to another person, who, in turn, alienated the mentioned property for the same price to the manager’s daughter.
As a result of the above-mentioned actions the real ownership of a real property with a total of 349.4 square meter area, at 15 million 581 thousand 693 thousand AMD cadastral value was hidden, its criminal origin was distorted. As a result, the condominium was deprived of the authority to possess the property provided by the community.
Public criminal prosecution was initiated against S.A. according to the Part 2 of the Article 214 and the Point 1 of the Part 3 of the Article 190 of RA Criminal Code adopted on 18.04.2003.
Bail and absence ban were applied as a pretrial measure against him.
The criminal proceeding with the bill of indictment was sent to the prosecutor.
