Preliminary investigation of the criminal proceeding initiated on participation in the criminal association, applying to a person having the highest status of the criminal hierarchy committed by the former prisoner of the penitentiary, the person having the highest status of criminal hierarchy – “criminal authority” was completed in Armavir Regional Investigative Department of the RA Investigative Committee.
In the result of investigative and procedural necessary actions it was grounded that the prisoner of “Armavir” penitentiary, the participant of the criminal association known as “Tolik”, while serving his sentence in the penitentiary, was applied to receive the debts from the prisoners in the same penitentiary.
The mentioned person involved in the criminal association, by using his influence to solve the problems on private issues – returning the debts, taking advantage of his status and carrying out relevant actions, solved the problems receiving illegal income for it.
It was also found out that while serving his sentence the mentioned prisoner known as “Tolik” was applied to give some advantage to persons taken to “Armavir” penitentiary by using his illegal influence.
On the base of the obtained sufficient evidence charge was pressed against the mentioned prisoner by the investigative body according to the Points 1 and 5 of the Part 3 of the Article 223.3 of the RA previous Criminal Code which corresponds to the Points 1 and 5 of the Part 3 of the Article 324 of the current Criminal Code.
Charge was pressed against one more prisoner according to the Part 1 of the Article 223.4 of the RA previous Criminal Code which corresponds to the Part 1 of the Article 325 of the current Criminal Code (applying to the participant of the criminal association or the person having the highest status of criminal hierarchy).
Preliminary investigation was completed and the materials of the criminal proceeding with the bill of indictment on two persons were sent to court.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
